CentraComm Communication’s Acceptable Use Policies (AUP) are set forth below. By contracting with CentraComm, you acknowledge that you have reviewed and agree to adhere to this AUP. These policies are not intended to control or limit your flexibility in experiencing all that our Services have to offer, rather are designed to ensure that our systems are secure, reliable, productive, and available to you when needed.
General
CentraComm customers are prohibited from utilizing CentraComm’s network in a manner that:
- Violates any applicable foreign or domestic regulation or law.
- Misappropriates the intellectual property rights of others.
- Exposes CentraComm to any civil or criminal liability.
- Violates the acceptable use policies of any network which has access to the CentraComm network.
Examples of such activities include but are not limited to: sending unsolicited email, utilizing, transmitting or receiving copyright protected material, scanning or monitoring any network including CentraComm’s without permission, distributing viruses, worms, Trojan horses, or other damaging/disrupting activities, falsifying header information or user’s identity, or advertising, storing, posting, distributing, or in any way making available obscene materials. More specifically:
- Intellectual Property – Materials publicly available via the Internet may also be protected under trademarks, copyrights, service marks, software licenses, patents, trade secrets, or other strictly proprietary information. Any action that infringes or misappropriates these protections can result in either a blocking of said content or a termination of service of customers who commit repeat violations.
- Damaging Content – Users shall not, through the use of CentraComm’s Services, distribute or transmit a virus, worm, Trojan Horse, pinging, flooding, mailbombing, or denial-of-service attack. Any activity that disrupts or interferes with others’ ability to effectively utilize the network is also expressly prohibited.
- Usenet Groups – Users of CentraComm’s Services are responsible for adhering to all rules associated with Web Services, chat rooms, newsgroups, bulletin boards, Web pages, and any other service that has rules, guidelines, and agreements associated with them. Any action to the contrary will be viewed as a violation of this AUP.
- Email – The distribution of unsolicited mail over the Internet (Spam) is forbidden under this policy. Any mail that includes commercial advertising, informational announcements, is harassing or intended as an annoyance, mailbombs, malicious e-mail, is unsolicited, or in which the receiver has asked the sendor not to send any further messages is considered a breach of this policy. Users may not falsify headers or maintain an open SMTP relay.
- Excessive Usage – If a User exceeds the space and/or bandwidth limitations of any CentraComm Service, that action will be viewed as breach of the Service agreement and/or AUP.
- Cooperation with Investigations – CentraComm will cooperate with law enforcement agencies and any other third parties involved in investigating claims of illegal activity.
- Network Security – Users are prohibited from attempts to gain unauthorized access or interference with the operation of the normal functioning or security of any network, system, equipment, account, facility, data, or information. A User may not utilize their CentraComm Service to monitor any network, system, data, or communication without prior authorization including passwords of other users.
Termination/Suspension
Any User that CentraComm determines to have violated any section of this AUP may be subject to suspension or termination of Service. CentraComm may take further action to prohibit future occurrences and will cooperate with law enforcement if said abuse is illegal.
